§ 1 DEFINITIONS

Terms and Conditions – these website terms and conditions;
Website – the website of CoolSens.eu
User – a natural person with legal capacity (in cases defined by law also a person with limited legal capacity), a natural person feesrunning a business or a legal person, to whom electronic services can be provided in accordance with the Website Regulations and legal provisions;
Administrator – entity being the legal owner of the Website, Inventia Sp. z o.o., Poleczki 23, 02-822 Warsaw, KRS 0000023113.

§ 2 GENERAL PROVISIONS

The Administrator provides his/her services on the basis of these Terms of Use, and entering the Website and using the content therein is tantamount to accepting its provisions.
The user who does not accept the provisions of the Terms of Use should not use the Website.

§ 3 INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights, including in particular copyright and trademark rights vested in all text, illustrations, photographs, sounds and other materials posted on the Website are the property of the Administrator or are subject to the permission of their owner.
Without the prior consent of the Administrator, the User may not:

use (copies/parts of) the Website or the designations contained in its content for commercial purposes;
modify (parts of) the Website or incorporate it into the content of other works (such as paper documents, blogs or third-party websites).

§ 4 SERVICES

The administrator provides the following services:

display content and information about the Administrator, including services and contact details;
the possibility of contacting the Administrator via the contact form;

Access to the CoolSens.eu website is free of charge.

§ 5 TECHNICAL CONDITIONS

Technical requirements necessary to use the Services:

a computer, laptop or other multimedia device with Internet access;
access to e-mail;
a current web browser: Mozilla Firefox, Internet Explorer, Opera, Google Chrome, Safari or Microsoft Edge;
Recommended minimum screen resolution: 1024×768.

§ 6 PARTY ACTION AND LIABILITY

The Administrator is entitled to interrupt or disrupt the availability and use of the Website if this is caused:

the need to repair, extend, modify or maintain the hardware or software;
reasons beyond the Administrator’s control (force majeure, acts or omissions of third parties).

The administrator is not responsible:

for non-performance or improper performance of the services specified in the Terms and Conditions if caused by third parties (in particular, telecommunications operators, providers of telecommunications lines and electricity);
for damage caused by the User’s actions or omissions, in particular for the User’s use of the services set out in these Terms and Conditions in a manner inconsistent with applicable law and the provisions of these Terms and Conditions, and for damage resulting from the provision of incomplete or incorrect data.

The Administrator may refuse to provide the services specified in the Rules if it is justified by security reasons and in other cases specified in the Rules or resulting from the provisions of applicable law.

The administrator reserves the right to:

extensions and/or changes to the software intended for the use of the services specified in the Terms and Conditions;
changes to the design and/or layout of the web pages intended for the provision of the services set out in the Terms and Conditions.

§ 7 COMPLAINTS

The User may address complaints on matters related to the use of the services set out in these Terms and Conditions to the email address abi@inventia.pl.

The administrator is obliged to consider the complaint within 14 days of receiving the complaint.

If the complaint has defects which make its consideration impossible, the Administrator may call the User to supplement it, specifying the deadline, no shorter than 7 days, and the scope of such supplementation with the instruction that failure to supplement the complaint within the specified deadline will result in leaving the complaint unprocessed. After ineffective lapse of the set time limit, the complaint shall be left unprocessed.

The Administrator shall send a reply to the complaint to the e-mail address indicated by the User.

§ 8 PRIVACY AND COOKIE POLICY

The Administrator is the Data Controller of the User’s Personal Data. Details of the processing of personal data can be found in the Privacy Policy and the Cookies Policy.

§ 9 FINAL PROVISIONS

In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular the provisions of the Act of 18 July 2002 on the provision of electronic services and the Act of 23 April 1964 – Civil Code.

The competent court for disputes arising from the provision of services shall be the court having jurisdiction over the Administrator’s registered office.

The Regulations are available on the Website and in hard copy at the Administrator’s office.

The Administrator reserves the right to temporarily suspend the provision of services due to modernisation or reconstruction of the Website or maintenance work on the ICT system on which the Website operates.

The Administrator reserves the right to amend the Terms of Use. Amendments shall come into force at the moment expressly indicated by the Administrator, but not earlier than after 7 calendar days from their announcement. Changes to the Terms of Use shall not result in limitation of the previously guaranteed rights of the User, unless such changes are the result of factors beyond the Administrator’s control.

The regulations come into force on 1.08.2024.
